U.S. Senators Lisa Murkowski and Dan Sullivan have expressed their concerns about the implementation of the Build America, Buy America (BABA) Act in a letter to the Office of Management and Budget (OMB). The senators highlighted the challenges faced by Native communities, particularly in Alaska, regarding infrastructure development due to factors such as a shortage of contractors, remote geography, and supply chain issues. They are urging OMB to grant a five-year waiver of the Buy America preferences for federal financial assistance to Tribes for infrastructure projects.
"Native communities – particularly those in Alaska – face incredible challenges when it comes to improving and developing infrastructure," stated Senator Murkowski. She emphasized that the unique conditions in Alaska make it difficult for these communities to meet BABA requirements without additional flexibility.
Senator Sullivan added, "Alaska is home to some of America’s most economically disadvantaged and infrastructure poor communities." He acknowledged the importance of buying American but stressed that current rules do not account for the limitations faced by remote areas.
Support for this waiver has come from various organizations. Sami Jo Difuntorum from NAIHC praised the senators' efforts, noting that an extended waiver would respect Tribal sovereignty. Jaqueline Pata from Tlingit Haida Regional Housing Authority also expressed gratitude for their proactive approach in addressing critical housing needs while balancing national manufacturing goals.
Gabe Layman from Cook Inlet Housing Authority warned that without this waiver, material shortages could delay necessary housing projects. Griffin Hagle from the Association of Alaska Housing Authorities echoed these sentiments, emphasizing the need for collaboration with federal agencies during this period.
