Alaska senators seek tribal waiver under Build America, Buy America Act

U.S. Senators Lisa Murkowski and Dan Sullivan, both representing Alaska, have reached out to the Office of Management and Budget (OMB) with concerns regarding the Build America, Buy America (BABA) Act's effects on infrastructure projects in Native communities. The senators argue that these communities face unique challenges due to a lack of contractors, remote locations, and ongoing supply chain issues.

In their letter to OMB, Murkowski and Sullivan requested a five-year waiver from the Buy America preferences for federal financial assistance to Tribes. They emphasized that without this waiver, the requirements could delay projects and increase costs for communities already struggling with limited resources.

Senator Sullivan highlighted Alaska's economically disadvantaged areas where housing shortages force multiple generations into single homes. He stated, "I generally support efforts to buy and hire American when administering federal resources, but those rules must account for remote communities with extremely limited workforces and strained supply chains."

Vice Chairman Murkowski added her voice by pointing out the specific difficulties faced by Alaskan Native communities in securing affordable housing due to geographical challenges. She noted feedback from Tribal leaders calling for flexibility during BABA's implementation.

Support for the senators' initiative came from various organizations. Sami Jo Difuntorum of NAIHC praised their advocacy for a five-year waiver as it respects Tribal sovereignty while allowing time for consultation on BABA's implementation. Jacqueline Pata of Tlingit Haida Regional Housing Authority expressed gratitude for their proactive approach in seeking balance between addressing housing needs and national manufacturing goals.

Gabe Layman from Cook Inlet Housing Authority also supported the call for a waiver due to current economic constraints impacting material availability needed for building homes. Griffin Hagle of the Association of Alaska Housing Authorities echoed appreciation towards Senators Murkowski and Sullivan’s efforts in urging OMB action.
